Abstract

当前共享经济快速发展下,实务界对网络服务平台与网约工是否存在劳动关系认定混乱,对传统劳动关系的认定标准产生了挑战,而打破同案不同判的窘境需要重塑劳动关系的认定标准.域外主体型和内容型的劳动关系发展为我国发展劳动关系提供了蓝本,在现有劳动、劳务二元保护模式下,放宽劳动关系的认定标准,将经济从属性强的网约工纳入劳动法保护之列是司法和立法的方向.
